电子商务领域专利保护的特殊利益平衡机制分析

在知识产权强国战略和大力发展电子商务产业两大政策背景下,电子商务领域专利保护面临严格保护和尽量简化电子商务平台工作流程的内在紧张关系。对此,我国《侵权责任法》作了原则性规定,《电子商务法》进一步完善了相关制度内容,但电子商务领域专利保护的复杂性决定了单纯依靠立法难以完全解决这一难题,需要在个案中进行多重利益之间的平衡。我国特有的专利行政保护制度弥补了相关立法方面的不足,而司法审判经验的积累则为公正合理的利益平衡机制的构建提供了借鉴。

Under the Two Policy Backgrounds of Intellectual Property Great power strategy and Vigorously Developing ECommerce Industry,E-commerce patent protection is facing the Internal conflict between strictly protecting patents and simplifying the workflow of e-commerce platform.Although China’s Tort Liability Law provides in principle,and the Electronic Commerce Law further improves the relevant system,but the complexity of patent protection in the field of electronic commerce determines that it is difficult to solve this problem completely by legislation alone.It’s more important to balance multiple interests in every specific case.Our country’s unique system innovation of patent administrative protection makes up for the deficiencies of relevant legislation,and the accumulation of relevant judicial trial experience guides the construction of a fair and reasonable interest balance mechanism.
