摘要
我国孤独症儿童教育立法尚处于起步阶段,相关立法和政策仍存在一定的缺失。在融合教育立法中,孤独症儿童就学标准不明、程序缺乏、权责主体不一,不能充分保障孤独症儿童的受教育权。本文在借鉴国外经验的基础上,建议在残疾人保障法中增加孤独症儿童教育规范内容,构建多形式的孤独症儿童教育机制,设立孤独症儿童教育第三方评判机制,以期对我国孤独症儿童教育立法的完善有所裨益。
China’s education legislation for autistic children is in its initial stage,and the diversity of types of education is lacking,and the existing legal provisions have not been fully implemented.In the legislation on integrated education,the standard of schooling for autistic children is unknown,procedures are lacking,and the subjects of power and subjects of responsibility are different.Existing legislation does not fully guarantee the right to education of autistic children,and the right to education of ordinary children in integrated education is not respected either. ased on reality and experience of foreign countries,this paper proposes to add the educational norms for autistic children to the law on the protection of disabled people,establish a multi-form education mechanism for autistic children,and set up a third-party evaluation mechanism for the education of autistic children.
