Discussion on Legal Risk Prevention of Social Capital Investment in Chinese Medical Clinics

目的:帮助社会资本把控投资中医馆的法律风险,促进中医馆产业健康长久发展。方法:收集中医馆产业发展现状相关新闻,分析总结。结果:中医馆产业近年来扩张迅速,但实现盈利的中医馆占比很小。社会资本在投资新设中医馆时面临着行政审批手续、经营管理方面的法律风险;在投资并购时面临着目标中医馆诉讼纠纷、权利瑕疵的法律风险。结论:中医馆产业投资法律风险需要社会资本在投资时理性调查分析,合理解决中医馆存在的问题以减少其中的法律风险。

Objective:To help social capital control the legal risk of investing in Chinese medicine clinics and promote the healthy and long-term development of Chinese medicine clinics industry.Methods:We collected relevant news reports on the development status of Chinese medicine clinics industry,and analyzed on it.Results:In recent years,the industry of Chinese medicine clinics has expanded rapidly,but the proportion of profit-making Chinese medicine clinics is very small.Social capital faces legal risks in administrative examination and approval procedures and management when investing in new Chinese medicine clinics,and legal risks in lawsuit disputes and rights defects of target Chinese medicine clinics when investing in mergers and acquisitions.Conclusion:The legal risk of industrial investment in Chinese medicine clinics needs rational investigation and analysis of social capital in investment,and reasonable solutions to the problems existing in Chinese medicine clinics can reduce the legal risk among them.
