HIV感染者及AIDS病人之性伴侣的权益保障初探

Discussions on the Rights and Interests Protection for the Sexual Partners of HIV-infected Persons and AIDS Patients

文章指出在我国现行法律框架下,过于强调保护HIV感染者及AIDS病人的隐私权,会致其性伴侣面临被感染的高度风险,而法律对其性伴侣权益的保护存在不足,故建议通过完善告知制度、改善救济途径,以保障HIV感染者及AIDS病人之性伴侣的权益。

Under the current legal framework in China, too much emphasis is placed on protecting the privacy of HIV-infected persons and AIDS patients, which puts their sexual partners at high risk of being infected, and leads to the insufficient legal protection for thier sexual partners’rights and interests. Therefore, this paper suggests taht the rights and interests of HIV-infected persons and AIDS patients’sexual partners should be protected by improving the information system and relief means.
