网络犯罪国际治理研究

Research on International Governance of Cybercrime

随着互联网的发展,网络犯罪不断涌现,严重威胁到社会安全。有效打击网络犯罪不仅需要解决立法、司法过程中面临的新问题,而且需要合理的刑事政策予以指引。“宽严相济”的刑事政策符合中国本土法律文化,并且在网络犯罪领域同样具有适用性。此外,当今世界各国已经走向互联网治理国际合作的新时代,而打击互联网犯罪的相关国际法机制尚不成熟,调节这一领域国家间关系的有效规范需要不断完善。通过对比《网络犯罪公约》与我国最高人民检察院发布的网络犯罪指导性案例,归纳出法律适用的相通性,有利于我国积极参与网络犯罪国际司法、执法合作。国际刑事法庭管辖权的扩大或专门法庭的建立同样有助于及时惩治网络犯罪。因此,在网络犯罪领域探讨刑事政策与国际治理问题十分必要。

With the continuous development of the Internet,cybercrime is on the rise,which poses a serious threat to social security.Combating effectively against cyber-crimes not only needs to solve new problems in the legislative and judicial processes,but also needs 155 the guidance of reasonable criminal policies.The criminal policy of “tempering justice with mercy” not only conforms to Chinese legal culture,but also appliesle in the field of cybercrime.In addition,although the world has stepped into a new era of international cooperation on Internet governance,international legal mechanisms to combat Internet crimes are still immature,and effective norms governing relations among countries in this field need to be improved.This paper compares the Convention on Cybercrime with guiding cases of cybercrime issued by China’s Supreme People’s Procuratorate in order to draw some common characteristics in law application.It can be conducive to China’s proactive participation in international cooperation in judicial and law enforcement of cybercrime.The expansion of the jurisdiction of the International Criminal Court or the establishment of specialized tribunal can also help to punish cyber-crimes in time.Therefore,it is necessary to discuss criminal policy and international governance in the field of cybercrime.
