摘要
学生到学校接受教育,与学校之间会产生两种不同性质的法律关系:一是教育管理关系;二是平等主体的民事关系。我国现行的教育法规就其性质和内容而言,归属于行政法,平等性的教育合同关系缺乏明确的法律规定。各地法院在受理和判决教育合同纠纷案件中存在诸多矛盾之处,本研究详细分析学历教育合同纠纷案件的主要争议焦点和法院处理思路,并在此基础上提出教育立法应注意的若干问题。
When students go to school to receive education, there occur two different types of legal relationships between them: One is the educational-administrative nature;the other being a civil relation between two equal agents. Based on their nature and contents, the existing educational laws and regulations fall into the category of administrative laws. The equality-oriented educational contract relationship lacks explicit legal stipulations. Consequently, abundant contradictions can be found in the dealing and verdicts of educational contract disputes, handled by courts across various regions. On account of a detailed analysis of the major dispute focus and court solution approaches in education contract disputes, this research attempts to highlight several noteworthy issues pertaining to the legislation of educational laws.
