从“一方俱乐部案”看国际体育仲裁院裁决在我国的承认与执行

Recognition and enforcement of CAS awards in China from an analysis of the “Yifang Football Club” case

作为CAS裁决在我国获得承认并执行的首例案件,"一方俱乐部案"兼具象征与实际意义。该案表明《纽约公约》可以作为CAS裁决在我国获得承认与执行的法律依据,并且为未来我国其他法院正确解释和适用《纽约公约》树立了典范。由于该案审理法院层级有限,在其他法院受理类似案件时,该案判决无法对其形成"软"约束力。此外,该案涉及的是具有商事性质的CAS裁决,非商事性CAS裁决是否可以根据《纽约公约》在我国获得承认与执行,仍有待未来司法实践予以回答。

As the first case in which a CAS award is recognized and enforced in China,the "Yifang Football Club"case has both symbolic and practical significance.It shows that the New York Convention can be applied as the legal basis for the recognition and enforcement of CAS awards.It also sets a good example for other People’s Courts in interpreting and applying the New York Convention.Nonetheless,as the level of the court hearing this case is limited,the sentence in this case cannot exert soft restraining power on future similar cases that will be heard by other People’s Courts.Also,this case concerns a CAS award with commercial elements.As a result,it remains a question to be answered by future judicial practice whether non-commercial CAS awards can be recognized and enforced according to the New York Convention.
