智慧法院:人工智能介入司法的隐忧与展望

Intelligent Court:Hidden Worries and Prospects of Artificial Intelligence Intervention in Justice

目前智慧法院处于初级司法智能化阶段,它以效率价值主导智慧法院改革,以公私合作研发推动司法信息化建设。但人工智能介入司法的过程也可能存在诸多问题,例如人工智能可能影响法官的自由裁量权、公私合作可能降低司法公信力及算法歧视可能影响司法正义等。因此,法院需要保障人工智能背景下法官的自由裁量权,不让法官的自由裁量流于形式;充分利用公私合作研发的优势,防止法院产生技术依赖;完善技术公平规则和算法司法审查原则,以规避算法歧视。

At present,the Intelligent Court is in the primary stage of judicial intelligence,with efficiency value to lead the reform of the intelligent court,and the public-private cooperation research and development to promote the construction of judicial information.However,there may be many problems in the process of artificial intelligence intervening in the judiciary.For example,artificial intelligence may affect the discretion of judges,and public-private partnership may fall.Judicial credibility and algorithmic discrimination may affect judicial justice.Therefore,the court needs to guarantee the discretion of judges in the context of artificial intelligence,to prevent the judges from discretion in the form;to make full use of the advantages of public-private partnership research and development to prevent the court from generating technical dependence;to improve technical fair rules and algorithms for judicial review principles to circumvent algorithmic discrimination.
