A Contrastive Study on the Application of Tendering and Bidding Law and Government Procurement Law

为给工程、设备、货物和服务采购的参与者提供法律依据和理论指导,围绕采购准备、供应商选择、合同签订及履行等阶段,对《招标投标法》及《政府采购法》两部法律领域的相关规定开展分析研究,找出两部法律在各阶段的异同点,并提出两法可依、鼓励低价优先等建议。

In order to provide legal basis and theoretical guidance to the participants in the procurement of engineering,equipment,goods and services and focus on the stages of procurement preparation,supplier selection,contract signing and performance,this paper analyzes and studies the relevant provisions of the fields of Tendering and Bidding Law and Government Procurement Law,finds out the similarities and differences between the two laws in each stage,and puts forward some suggestions that the two laws can be followed and lower price priority is encouraged.
