论犯罪中止自动性的判断

On Judgment of Crime Desistance Automaticity

作为犯罪的未完成形态之一,犯罪中止具有时间性、自动性、有效性、彻底性等特征,而自动性作为犯罪中止最本质的特征,对于从理论与实务上判断犯罪中止成立具有重要意义。学界围绕着犯罪中止自动性判断的对象及方法存在诸多学说与争议,在对不同学说展开阐释与评价的基础上,提出应从外部事由的认知状况、外部事由对主观心理的作用、“存疑时有利于行为人”原则等角度分层次地对犯罪中止自动性进行判断的研究进路。

As one of unfinished forms of crimes,crime desistance features timeliness,automaticity,effectiveness and thoroughness,of which automaticity is the most essential feature that is of significance for theory and practice-based judgment of crime desistance.Revolving round a number of theories and controversies existing in the subjects and methods in judgment of crime desistance automaticity,the scholars propose research approaches for judging crime desistance automaticity in ahierarchical way on the basis of cognitive status of external causes,the effect of external causes on subjective psychology,and the principle"in favor of the doer when in doubt".
