少年家事审判联合发展的路径探析

在当前我国社会发展形势下,构建相对独立的家事法院与少年法院都存在较大难度。但是,随着涉少案件以及家庭案件审判理念的不断转变,二者之间机制理念的整合以及构建少年家事审判制度也已经成为社会发展过程中非常重要的一种趋势。因此,我国需要有效明确少年家事审判制度在未来发展过程中的构建与改革理念,走一体两翼化发展路线,追求司法、社会的一体化价值实现,逐渐完善我国少年家事审判制度。爱护未成年人是人类文化价值的体现之一,在审判诉讼过程中,作为特殊诉讼主体的未成年当事人理应受到国家、社会的更多保护与关注。少年审判庭是以推动专业化审判、促进未成年人利益最大化为目的,设立三十多年来,其在发挥未成年人犯罪惩治、犯前预防和犯后矫治等方面发挥了重要作用。这里在深入剖析少年审判庭现状背景、理论制度的基础上,有针对性地探索少年审判与家事审判联合的改革路径。

In the context of present social development in China,it is quite difficult to construct relatively independent family courts and juvenile courts. However,as there is a gradual convergence of the judicial concepts of juvenile cases and family cases,it has been a social development tendency to realize the integration of the concepts and mechanisms of the two and to construct the juvenile family trial system. Therefore,it is necessary to confirm the future reform concept of juvenile family justice system,adhere to the development route of"one body with two wings",achieve the integration of judicature and society,and gradually improve juvenile family trial system in China. Caring for the juveniles is a reflection of human culture value. In the process of trial and litigation,the juveniles,as a special subject of litigation,deserve more protection and attention from the country and the community. For the purpose of promoting professional trial and facilitating interest maximization of the juveniles,Juvenile Court has been playing an important role in punishment of crimes,crime prevention,correction after crimes and other aspects for the juveniles for over thirty years since its foundation. There is an absolute need for studying countermeasures. On the basis of deep analysis of the current situation,background,theories and systems of the juvenile court,this paper explores the reform path of the combination of juvenile trial and family matters trial with specific purposes.
