民族地区传统村落立法保护实践探析——以恭城瑶族自治县为例

民族地区传统村落的发展和保护面临着新情况和新问题,《恭城瑶族自治县传统村落保护条例》的出台是民族地区利用单行条例有效保护传统村落的有益尝试,其成功经验值得其他少数民族自治地方参考和借鉴。民族自治地方传统村落保护条例效力范围的确定、民族自治地方传统村落保护条例与上位法的互动与协调、建立传统村落保护工作协调机制、为公众参与和财政投入提供法律保障等问题的解决,为进一步完善民族地区传统村落保护立法积累了宝贵的经验。

As the development and protection of traditional villages in ethnic areas are faced with new situations and new problems,the promulgation of Regulations on the Protection of Traditional Villages in Gongcheng Yao Autonomous County is a useful attempt to effectively protect traditional villages in ethnic areas by means of separate regulations,which provides successful experience of reference for other ethnic autonomous areas to improve traditional village protection legislation in terms of the determination of the effectiveness scope of the protection regulations,the interaction and coordination of these protection regulations and the higher-level laws,the establishment of a coordination mechanism,and the legal guarantee for public participation and financial input.
