摘要 劳动保障监察是政府构建和谐劳动关系的关键性行政力量,中国特色和谐劳动关系发展理念决定了其既要履行为劳动权益实现提供国家保护的责任与义务,又要确保经济持续健康发展、社会和谐稳定的双重价值目标。劳动保障监察职能定位应以“二元”本质属性特征为基本出发点。基于对劳动监察职能国际发展趋势与新时代对劳动保护升级现实要求的综合考量,劳动保障监察职能范围广泛性的制度安排具有现实合理性。当前引发劳动争议的主因源自雇主劳动违法的客观现实,以及劳动执法权与行政调解手段的职能优势互补特点,劳动保障监察作为劳动争议多元处理机制参与主体兼承的调解职能制度扩容也成为必要,但应按类型划分实行分类处理。 Labor security inspection is the key administrative method in the process of constructing harmonious labor relations,the concept of harmonious labor relations with Chinese characteristics determines that it should not only fulf ill the responsibility and obligation of providing state protection for the realization of labor rights and interests, but also ensuring sustained economic development and social harmony and stability. The position of labor security inspection function should be based on the essential attribute characteristics of "dualism". In view of the international development trend and the upgrading of labor protection in the new era, the system arrangement of the wide scope of labor security inspection function has realistic rationality. The objective reality that the main causes of current labor disputes originate from employers' labor violations ,as well as the complementary characteristics of the functional advantages of the labor law enforcement right and the administrative mediation, which makes it also necessary for labor security inspection, as a pluralistic labor dispute settlement mechanism participants, to expand the labor dispute mediation function, but it should be treated according to typology.
