中国数字音乐平台版权垄断的反垄断法分析 被引量:1

摘要 数字音乐产业发展迅猛,数字音乐平台为了取得竞争优势争相获得版权的独家授权和独家代理。面对可能出现的垄断问题,反垄断法规制显得十分必要,数字音乐版权方独家授权行为可能涉及转售价格维持的纵向垄断协议,数字音乐平台独家代理可能涉及以不公平高价转授、拒绝转授和差别待遇的市场支配地位滥用行为。在认定行为违法性时,应根据具体案件事实进行合理性分析。 With the rapid development of digital music industry, digital music platforms compete for the exclusive authorization and exclusive agency of copyright in order to gain competitive advantage. In the face of possible monopoly problems, analysis from the perspective of anti-monopoly law is necessary. The exclusive authorization of the digital music copyright owner may involve the vertical monopoly agreement for the resale price maintenance. The exclusive agency of the digital music platform may involve the abuse of dominant market position for delegating at excessive prices, refusing to delegate and treating differently. In determining the illegality of the act, the rationality analysis should be carried out according to the facts of the specific case.
