论我国公民平等受教育权的行政法保护 被引量:2

摘要 公民平等受教育权是教育公平的重要内涵和核心内容,保障公民平等受教育权的主要责任在政府。我国公民平等受教育权行政法保护主要存在保护理念有待提升、立法体系尚待完善、具体内容和保障措施需要明确、监督和救济途径亟需拓展等方面的不足。完善与改进我国公民平等受教育权的行政法保护,可采取以下措施:在立法中突出公民受教育权保护的“平等”理念与原则,制定《教育公平促进法》,完善以宪法为基础、以教育法为基本、以其他各类教育法律法规规章为整体框架的立法体系,明确公民平等受教育权的具体内容,采取各种有效的保障措施,拓展监督与救济途径。 Citizens * right to equal education is an important connotation and core content of educational equity, and the government takes the major responsibility for the guarantee of citizens * right to equal education. In terms of the protection of citizens * right to equal education, there exist the following shortcomings in the administrative law of our country: the concept of protection needs to be improved, the legislative system needs to be perfected, the specific content and safeguard measures need to be made clear, and the ways of supervision and relief need to be expanded. To improve the administrative law protection of citizens' right to equal education in our country, we can adopt the following measures: highlighting the concept and principle of "equality ” in the protection of citizens * right to education in legislation, formulating the Law on the Promotion of Educational Equity, improving the legislative system with the Constitution, the Education Law and other laws and regulations on education as a whole framework, clarifying the specific content of citizens * equal right to education, and taking various effective safeguards to expand the channels of supervision and relief.
