我国专利运营现状及知识产权金融发展策略探析

Analysis on the Present Situation of Patent Operation and Development Strategy of Intellectual Property Finance in China

本文从我国专利运营的现状进行分析,阐述了目前专利运营的特点及不足,并指出今后我国专利运营及知识产权金融的发展方向。其中通过对现有专利运营数据及行业发展的分析,得出我国目前专利运营现状的四个特点,即专利运营机构的类型和数量迅速增加、常规专利运营项目活跃、专利运营模式开始从单一走向产业化、多元化和金融化及重视高质量专利的培育;并通过与国外成熟知识产权金融模式的对比,得出我国目前专利运营的一些不足。通过分析,指出我国今后在知识产权金融发展上需要进一步加强法律环境的改善、运营机构的协作融合以及进一步加强国家在宏观指导及人才培养方面的力度。

This paper analyzes the present situation of patent operation in China, and expounds the characteristics and shortcomings of the current patent operation, and points out the development direction of the patent operation and IP fi nance in the future. Through the analysis of the existing patent operation data and the development of the industry, the four characteristics of the present patent operation current situation in China are obtained, namely, the type and the quantity of the patent operation institutions are rapidly increased, the conventional patent operation projects are active, and the patent operation mode starts from a single direction to industrialization, diversifi cation and fi nancialization,and the emphasis on the cultivation of high-quality patents;and through the comparison with the foreign mature patent financial model, we know some of the shortcomings of our current patent operation. Through these analyses, we need to further strengthen the improvement of the legal environment in the development of IP fi nance in our country in the future, the cooperation and integration of the operation institutions, and further strengthen the national macro-guidance and the personnel training.
