关于学前教育立法的几点思考~

摘要 “学前教育法”已经列入十三届全国人大常务委员会的立法规划。在全面依法治国、推进科学立法的背景下,学前教育法的制定面临立法依据、立法条件、立法的价值导向、立法对于中华优秀传统文化传承发展、立法主体范围等事关立法质量的一系列问题。只有在这些基本问题上形成广泛的共识,使社会共识形成制度化的规范,“学前教育法”才可能为学前教育的“善治”提供“良法”基础。 The Law on Preschool Education is one of the first projects in the legislative plan announced by the 13th National People’s Congress.The Central Committee of the Communist Party of China and relevant national departments pay close attention to the development and reform of preschool education.Under the guiding ideology of comprehensively advancing the rule of law,the discussion and drafting of the legislation of the people’s congress in the preschool education field is particularly important.In the theoretical circles of education and sociology,the issue of preschool education has formed a certain consensus,but social consensus and choice must form institutionalized norms.Based on China’s current legislative system and procedures,the legislation of preschool education faces legislative issues,legislative conditions,and basic values in the context of legislation.Only by confronting these basic levels of dilemma can we better promote relevant legislation.
