学前教育立法体例的思考——基于地方学前教育立法体例的统计分析

摘要 学前教育立法体例是指学前教育法律规范的组织形式。国家学前教育立法体例具有节约地方立法资源、总结学前教育基本规律和支撑地方进一步立法的功能,而学前教育立法体例决定于需要解决的主要现实问题和现有的法律资源。各地学前教育立法特别是新近完成的立法,其体例所呈现的规律对于国家立法具有借鉴意义。国家学前教育立法体例应注重回应学前教育设施规划建设、流动人口子女入园难、保育教育活动的监督和学前教育均等化等突出问题。与此对应,采取九章制的立法体例,使学前教育基础设施规划建设、学前教育机构工作人员单独成章,并且注意法律名称、工作对象等相关概念的统一。 The legislative system of preschool education refers to the organizational form of preschool education legal norms. The national preschool education legislation has the function of saving local legislative resources, summarizing the basic laws of pre-school education and supporting local legislation. The legislation of preschool education is determined by the main practical problems that need to be resolved and the existing legal resources. The preschool education legislation in various places,especially the newly completed legislation, the laws presented in its style have reference significance for national legislation. The national preschool education legislation should focus on responding to the preschool education facilities planning and construction, the difficulty of children of migrant children entering the park, the supervision of conservation education activities and the equalization of preschool education. Correspondingly, the nine-chapter legislative system is adopted to make the preschool education infrastructure planning and construction of the preschool educational institutions separate, and pay attention to the unification of related concepts such as legal names and working objects.
