摘要
"法律是什么"的问题是法学理论专业研究生教学中的核心问题,为展示法律概念的丰富性与复杂性,文章从微观层面的教学目的出发,以法律实证主义相关理论为背景,对哈特理论中的"社会规则"概念和麦考密克理论中的"非正式规范秩序"概念进行了较为深入的对比和说明,为强化研究生对法律概念的基本认识提供基本资料,并在教学方法上做出一种尝试,最终明确法律概念的辨析对于法理学相关内容学习的重要意义。
The question of "what is law" is the core issue in the teaching of graduate students who major in jurisprudence. Starting from the microscopic level of pedagogical purposes, the author takes the theory of legal positivism as the background, and thoroughly differentiate and explain the concepts of Hart' s "social rules" and MacCormick's "informal normative orders" in order to demonstrate the richness and complexity of legal concepts. The author makes such an attempt in pedagogy of jurisprudence to provide basic information for strengthening graduate students ' basic understanding of legal concepts. With the differentiation of legal concepts, the significance of studying relevant knowledge in jurisprudence can be clarified.
