《TRIPs协定》第73条对知识产权保护的安全例外进行了规定。在传统的国家安全观下,《TRIPs协定》第73条并无太大的适用空间。但随着国家安全范畴的扩大,对《TRIPs协定》第73条的理解也需进行调整。对于国家安全例外,《TRIPs协定》从一般原则到具体制度均有适用的空间。"卡塔尔案"引起了国际社会就知识产权与国家安全关系问题的激烈讨论,其中就包括安全例外条款的援引问题,还涉及到是否适用WTO争端解决机制、《TRIPs协定》第73条的性质、争端的具体性质等问题。《TRIPs协定》第73条的适用应当遵循自裁决原则,但同时也要对其进行限制。在总体国家安全观的背景下.我国应当从国家战略层面关注知识产权与国家安全之间的关系,并进行相应的法律和政策调整。

Article 73 of TRIPs regulates the security exceptions of intellectual property protection. Under the traditional concept of national security, there is not much room for the application of Article 73 on security exceptions. However, with the scope of national security expanding, the understanding of the provision needs to be adjusted. According to national security exceptions TRIPs can be applied from gen eral principles to specific systems. The "Qatar case" has caused a heated discussion among the interna tional community on intellectual property rights and national security, including the reference to the secu rity exception clause, the application of the WTO dispute settlement mechanism, the nature of Article 73 of TRIPs, and the specific nature of the dispute. The application of Article 73 of TRIPs shall follow the principle of self-adjudication, which should also be limited at the same time. Against the background of o- verall national security, China should also pay attention to the relationship between intellectual property rights and national security, and make corresponding adjustments in law and policy.
