摘要
我国现行的法律法规和司法解释,并未对房地产开发企业的破产清偿顺序作出集中的专门规定。我国《企业破产法》第109条规定了担保权人的优先权,《合同法》第286条规定了建设工程承包人的优先受偿权,此外,《最高人民法院关于建设工程价款优先受偿权问题的批复》也对相关主体的法律地位作出了一些具体的规定。法律从司法实践角度作出了具体的利益分配,为解决实践中的问题提供了具体的指导;从理论上来看,对购房者的法律地位进行具体的分析,有利于厘清相关权利的具体内涵,以便更加准确地适用法律,为司法实践提供指导。
