Shaping Grassroots Courtroom:From China’s Alternative Practices

从中国基层法庭空间的某些另类实践出发,可以探索法庭空间的新型理论框架。从环境心理学和更广泛的社会心理学看,中国基层法庭另类实践中体现的“感受相互性”和“空间重叠”的概念,是推进法庭空间理论再理解的引擎。由此而进,在法庭空间的理性、庄重、冷峻之外看到感性、活泼、暖心的价值,并看到不同案件纠纷类型适用不同法庭空间塑造的制度意义,可以提升司法活动的整体社会适应能力,增进司法的社会认同。

By observing the certain alternative practices of China’s grassroots courtroom space, we would be able to explore a new theoretical framework for the space. From the perspective of environmental psychology and broader social psychology, the concepts of “feelings of mutuality” and “spatial overlap” embodied in the practices are an engine that pro motes the reinterpretation of court space theory. As a result, seeing the values of sensibility, liveliness, and warmth outside the rational, dignified, and grim atmosphere of the space, and also seeing the institutional importance that the dispute types of different cases could apply different courtroom shaping, that could promote the social adaptability of judicial activities and enhance judicial social identity.
