法律漏洞补充行为的失范与规制

基于“禁止法官拒绝裁判”原则和诉讼效率需要,法官应当在其权限范围内对法律漏洞予以补充。但是,通过对司法案例的梳理可以发现,我国法官并不擅于法律漏洞补充操作,导致裁判效果难以令人满意。为了解决上述问题,提升裁判结论的正当性,保障同类案件法律适用的统一性,需要对法官的法律漏洞补充行为进行规范。划清权力边界,可以将法官的权力约束到职权范围之内;设定法律漏洞补充原则,则可以使法官的裁量实现真正的自由。

Based on the principle of"prohibiting judges from rejecting judgment"and the need of litigation efficiency,judges should supplement legal loopholes within the scope of their jurisdiction.However,through the analysis of judicial cases,it can be found that Chinese judges are not good at supplementing legal loopholes,resulting in unsatisfactory judgment effect.In order to solve the above problems,enhance the legitimacy of judgment,and ensure the uniformity of the application of law in similar cases,it is necessary to standardize the supplement act of legal loopholes.By delineating the boundaries of power,the power of judges can be restricted to the scope of its functions.Setting up the principle of supplementing legal loopholes can realize the real freedom of judges'discretion.
