网络犯罪时代犯罪现场概念的新定位——基于“双重化”犯罪现场视角

The New Orientation of Crime Scene Concept in Cybercrime Era——Based on the “Two Tier” Perspective of Crime Scene

在网络犯罪时代,传统的犯罪现场概念面临着定位局限性的弊端,难以涵盖网络犯罪现场的特质,需要融合网络虚拟空间从“双重化”犯罪现场研究视角进行重新审视。当前学界对于犯罪现场的概念进行了诸多有益的研究,对其进行整合分析,找出集中性的问题所在,对“双重化”犯罪现场的研究视角进行优势解读,并从“行为标准”“客体”“归属”三个角度对犯罪现场的概念提出具有创新性的见解,给予新的定位。

In the era of cybercrime,the traditional concept of crime scene is faced with the limitation of positioning,which is difficult to cover the characteristics of cybercrime scene,and needs to be re-examined from the perspective of"Two tier"crime scene research by integrating cyberspace.The concept of crime scene has been studied profitably in the current academic circles,and the problems of centralization have been found out through integrated analysis.Finally,this paper interprets the advantages of the research perspective of"Two tier"crime scene and puts forward some innovative views on the concept of crime scene from the three angles of"behavior standard","object"and“attribution",and gives a new orientation.
