高等院校法律援助工作的问题与对策

Problems and Countermeasures of Legal Aid Work in Universities

高等院校向社会提供的法律援助在教学、科研与社会服务方面有着重要价值。但在实践中,我国高等院校不能设立律师事务所,学生没有参与案件办理的特殊权利,高校管理者对法学学科的建设理念陈旧,法律援助欠缺案源、资金等支持,这些因素严重制约了法律援助工作的有效开展。为了促使和鼓励高等院校从事法律援助工作,我国应允许高校设立专门从事法律援助的律师事务所,赋予学生“实习律师”的权利,加强对高校法律援助工作的资金和案源支持,同时高校自身也应更新法学学科的建设理念。

Legal aid provided by universities to the society has important value in teaching, research and social services. However, Chinese universities cannot set up law firms in practice and students do not have special rights to participate in case handling, College administrators have an outdated concept of law discipline construction, and legal aid lacks support for case sources and funds. These factors seriously restrict the effective implementation of legal aid work. In order to promote and encourage universities to engage in legal aid work, China should allow universities to set up law firms specializing in legal aid, grant students the right to "training lawyers", and the funding and case support for legal aid work shall be provided to universities. And it is also necessary to update the construction concept of the law discipline.
