浅析网络空间里的被遗忘权

On Forgotten Right in Cyberspace

随着技术的革新与发展,互联网在人们的生活中愈加重要。永久性是网络特有的属性,任何人在网络时空做的任何事,留下的任何信息,不论你的意愿是什么,都会永久的留存在网络中。由于有些网络记忆会带来不利的后果,为了解决该问题,被遗忘权被提了出来。欧盟和美国对被遗忘权的态度具有一定代表性,通过对二者进行比较,结合我国国情和现状进行分析,探讨被遗忘权中国化的实现途径。

With the innovation and development of technology, the Internet is becoming more and more important in people's life. Permanence is the unique attribute of the network. Whatever anyone does in cyberspace, any information left behind, no matter what your intentions, will remain permanently in cyberspace. Since some network memories have unfavorable consequences, the right to be forgotten has been raised in order to solve this problem. The attitude of the European Union and the United States towards the right to be forgotten is representative to some extent. By comparing the two, combining with China's national conditions and current situation, this paper explores the ways to realize the right to be forgotten in China.
