摘要
社区物业治理绩效为什么会呈现出如此大的差异?我们认为源于关联物权的关联密度是影响社区物业治理绩效的更为根本的因素。关联密度=所有关系强度+空间距离+共同体价值+组织连带,这样一种关系式衍生出两重逻辑,即所有关系衍生的制度逻辑:双重委托代理关系,即业主与业委会之间、业委会与物业服务企业之间的委托代理关系;空间距离衍生的议题逻辑:影响分布不平衡。这两重逻辑同时嵌入共同体和党政体制之中,产生连带责任。基层政权此时需要根据问题的来源:双重委托代理衍生的合作与冲突、嵌套统合机制衍生的依附与自主来界定现实情境,即根据物业治理主体的四种关系形态:依附合作、自主合作、依附冲突、自主冲突,来具体决定何时和如何干预,总体上,形成一种自主性吸纳的干预方式。
Why different communities have divergent property governance performances We think it is the association density derived from associated property rights that plays this more fundamental role. Association density= Ownership intensity + Space distance + Community value + Organizational linkage, double logics deduce from this relational expression: the institutional logic which focuses on the dual principal-agent relationships and the issue logic which highlights the unbalanced influence distribution. The double logics which are embedded in the community and party government system lead to linkage problem. The local government needs to identify the temporary situations based on relationships between these governance actors, that is, four relational types: dependence-cooperation, autonomy-cooperation, dependence-conflict, autonomy-conflict. By this way, the local government then can determine when and how to regulate these relations. As a whole, these regulation methods can be called autonomous absorption.
