摘要
近年来我国疫苗事件频发,但事后无论是针对疫苗制造商的索赔、还是国家补偿,都陷入了困境。英国《1979年疫苗损害补偿法》和美国1986年《国家儿童疫苗伤害法案》都对受到疫苗伤害的儿童进行了国家补偿,由国家分担受到疫苗伤害的儿童及其家庭的不幸。英美两国儿童疫苗伤害国家补偿制度对我国的制度变革启示良多.
In recent years,the vaccine incidents in China have occurred frequently,but both the claims against vaccine manufacturers and state compensation have been in trouble.The"Vaccine damage compensation Act 1979"of Britain and the"National Child Vaccine injury Act 1986"of the United States had stipulated the government should give the children who have been injured by the vaccine some compensation to share the misfortune of the children and their families who are victims of the vaccine.The national compensation system for children vaccine injury in the two countries have a lot of inspiration to our country's institutional reform.
