摘要
教育公益诉讼内在的特质决定了其可以有效地解决我国教育领域的诸多问题,促使教育法律法规的形成与完善,推动教育制度变革和促进教育制度的良性发展。目前我国设置教育公益诉讼的时机已经成熟,既有的立法基础、司法实践尝试和国外的立法经验保障了教育公益诉讼设置的可行性。教育公益诉讼应首先向义务教育权利保护领域、学校教育方式和质量领域、平等受教育权领域和社会教育培训治理领域开放。最终通过《民事诉讼法》《行政诉讼法》和《教育法》双重规定的方式,在我国构建独具特色的教育公益诉讼制度,有力地倒逼教育体制改革。
The inherent characteristics of Educational public interest litigation enable it to effectively solve many problems in the field of education in China, to promote the formation and perfection of education laws and regulations, and give impetus to the reform of the educational system and the benign development of the educational system. At present, the time of setting up educational public interest litigation in China is right, and the feasibility of setting up educational public interest litigation is guaranteed by the existing legislative basis, judicial practice and foreign legislative experience. Educational public interest litigation should first be open to the fields of protecting compulsory education rights, school education methods and quality, equality of education and governance of social education training. Finally, through the dual provisions of the Civil Procedure Law, the Administrative Procedure Law and the Education Law, characteristic educational public interest litigation will be established, and it will force the reform of educational system.
