娱乐是使人快乐的意思,是当下中国"人民美好生活"的重要体现。为避免我国蓬勃发展的娱乐产业之野蛮生长,更好地促进娱乐产业的有序进步,实现娱乐产业规则之治,有必要将散布在不同部门法中的、与娱乐业相关的规则萃取提炼出来,形成统一的"娱乐法",并按照产业的逻辑安排其内容体系,从而有助于娱乐法规范体系的构建和法律制度的适用。娱乐法是适用于整个娱乐产业,并为产业发展保驾护航的法律规范系统的总称。它包括法律规则、法律原则和商业惯例等几种不同的法律渊源和规范形态。娱乐法是一个实用主义的、以问题与实践为导向的综合性法律领域,有别于传统的以逻辑为基础加以划分的法律学科部门,是具有"领域法"特色的典型产业之法。从内容体系上来看,娱乐法根据产业逻辑划分为电影法、广播电视法、音乐法、文艺演出法、网络视听法、电子游戏法、体育法七部分,每部分内容同样按照一定的法律逻辑来安排其体系,也均包含主体、流程、合同、著作权保护、行政管理等内容。娱乐法代表了未来法学学科划分与法律发展的趋势与方向。

Entertainment is a means to make people happy. It is an important manifestation of China’s"a better life for the people"Entertainment law is a general term for legal systems that apply to the entire entertainment industry and protect the industry. It includes several different sources of law and norms,such as legal principles,legal rules,and business practices. Entertainment law is a pragmatic,problem-oriented and practice-oriented comprehensive legal system. It is different from traditional legal disciplines and legal departments that are divided on the basis of logic. It is a typical industrial law. From the content system perspective,entertainment law is divided into seven parts according to industrial logic: film law,radio and television law,music law,theatrical performance law,internet audio-visual law,video game law,sports law,and each part of the content is also in accordance with certain legal logic to maintain an organic system. They all include subjects,processes,contracts,copyright protection and administrative management. The entertainment law represents the trend and direction of the division of law discipline and legal development in the future.
