《国王的两个身体》的“荒谬”

摘要 康托洛维茨的《国王的两个身体》可以采用政治诗学的读法,也可以采用宪制史前传的读法,都有理据,也都有曲误。施米特政治神学的读法不足以领会康著所呈现的中世纪未经分化和撕裂的圆融世界,宪制史前传的读法不足以解释宪制史上的诸多困境和曲折。康著不是一个平铺直叙的线性结构,而是一个无穷回环的复杂结构,悖论以"荒谬"的形式不断展开,不断升级。王权观念的戏剧化呈现正是悖论的绝佳形式,莎士比亚和但丁的剧作展现出"国王的两个身体"最鲜活的形态。政治中的悖论不可能被消解,但处理和安顿悖论的学科却从神学转移到了法学。法学是现代世界中世俗化的神学,它通过创造法学概念和范畴安顿悖论,创造出一个高于生活世界的抽象世界,使纷繁多元的世界获得统一性和规范性。 Ernst Kantorowicz’s King’s Two Bodies can be read not only by the method of political poetics also by the method of constitutional prehistory,both of which have its reasons and errors. The former,method of Political theology of Carl Schmitt,cannot deeply enough comprehend the medieval harmonious world which Kantorowicz’s work unfolded. The Latter,method of constitutional prehistory,cannot deeply enough explain the complications and dilemmas. Kantorowicz’s work is not a linear but a ring structure which exhibited the paradoxes by the form of absurdity. The Dramatic exhibition of conceptions of kingship is the best form of paradox. The Dramas of Shakespeare and Dante showed the vivid king’s two bodies. Paradox in politics cannot be eliminated,but the discipline which managed paradox moved from theology to jurisprudence. Jurisprudence is the secularized theology in modern world. By creating jurisprudential concepts and categories it creates an abstract world and endows the plural world unity and normativeness.
