高校科技成果转化中知识产权权利冲突问题探究

高校科技成果转化中的知识产权权利冲突主要体现在专利权之间、专利权和著作权、商标权和著作权,以及商标权和外观设计专利权间的相互冲突,主要由于其内生裂变机制、权利自身特性,以及立法与执法的分散性等诸多方面的原因,对高校科技成果转化造成“产学研”一体化联盟内部契约失稳、转化效率低下、成员信任危机、法律救济成本过高等多方面的影响。若要解决以上难题,则应当着力加强成员甄别能力和评价标准、提高成果转化中知识产权人的法律意识、建立协调公平的联盟利益分配机制、加强高校与企业间的信息交流等措施。

The conflicts of intellectual property rights in university scientific achievement transformation are main.ly reflected in the conflicts between patents,patents and copyrights,trademarks and copyrights,as well as trademarks and design patents.These conflicts are mainly caused by the endogenous fission mechanism,the characteristics of rights and the decentralization of legislation and law enforcement.These conflicts have many negative effects on uni.versity scientific achievement transformation,such as the internal instability in industry-university-research-alliance,in.efficient transformation,members’trust crisis and high cost of legal relief.To solve the above problems,we should fo.cus on strengthening members’screening ability and evaluation criteria,improving the legal awareness of intellectual property owners,establishing a coordinated and fair mechanism for the distribution of alliance interests,and strength.ening information exchange between universities and enterprises.
