摘要
"互联网+"时代有必要为我国档案数据开放构建法律与政策层面的安全保障。从档案数据开放的法系背景出发,通过对英美法系国家档案数据开放的学术文献、法律与政策文本以及经典案例分析,可知英美法系国家档案数据开放法律与政策研究在世界五大法系中起到了较好的引领和表率作用。要促进"互联网+"时代我国档案数据开放法律与政策建设,应学习英美法系国家档案数据开放法律与政策的先进经验,完善我国档案数据开放行为法、档案数据开放救济法、档案数据开放权利保护机制、档案数据开放政策以及档案数据开放技术标准体系。
In the era of "Internet +",it is necessary to construct the legal and policy security guarantee for China's opening of archival data. Starting from the law system background of archival data opening, based on the analy sis of the archival data opening academic literature, law and policy as well as the classic case in common law coun tries, It can be known that the common law system countries archival data opening law and policy research play a leading and demonstration demonstrative role in the world' s five legal systems. In order to promote the construction of the opening of archival data law and policy in our country in the era of "Internet+", China should learn common law countries the advanced experience of archival data opening law and policy, to perfect the archives behavioral law in our country;to perfect the archives relief law in our country;to build up the protection mechanism for data rights in archives in our country;to build up the archival data opening policy system and the archival data opening technical standards system in our country.
