我国植物新品种行政执法的困境与对策

Research on Administrative Law Enforcement of New Plant Varieties ——From the Perspective of the First Document of the Party Central Committee in 2019

2019年中央一号文件指出:“加强农业领域知识产权创造与应用”。植物新品种行政执法对于农作物等植物新品种的知识产权保护是必要的且是不可或缺的。当前,我国植物新品种行政执法立法制度不够健全、执法机构设置不尽合理、行政执法的难度日益加大,这些都不同程度地影响到植物新品种行政执法的效果。为实现植物新品种行政执法效果,我们应当制定植物新品种保护单行法,确立行政执法的基本原则,扩大植物新品种行政执法内容,完善植物新品种行政执法体系,精准定位侵权行为的构成要件,不断地健全和完善植物新品种行政执法机制。

The first document of the Party Central Committee in 2019 points out that the creation and application of intellectual property rights in agriculture should be strengthened.The administrative enforcement of new plant varieties is necessary and indispensable for the protection of intellectual property rights of new plant varieties such as crops.At present,the legislative system of administrative law enforcement of new variety of plants in China is not perfect,the establishment of law enforcement agencies is not reasonable,and the difficulty of administrative law enforcement is increasing,which affect the effect of the administrative law enforcement of new plant variety to varying degrees.In order to realize the effect of the administrative law enforcement of new plant variety,we should formulate the special regulations of protecting the new variety of plants,clarify the basic principles of administrative law enforcement, expand the administrative law enforcement content of new plant variety,and improve the administrative law enforcement system of new plant variety.We should clearly position the constituent elements of the tort,and constantly improve and perfect the administrative enforcement mechanism of new plant variety.
