论我国国防法治建设七十年的创新发展

On the Innovation and Development of China’s National Defense of the Rule of Law in the Past 70 Years

国防法治建设是中国特色社会主义法治体系的重要组成部分,涵盖了国防和军队建设的各主要领域。中华人民共和国成立70年来,我国的国防和军队建设始终在国家法治的轨道上运行,走过了光辉历程。初创时期奠定了国防法治建设发展的坚实基础;改革开放推动了国防法治建设全面发展;党的十八大开启了国防法治建设的新时代。目前我国国防法治建设已经形成了党领导国防法治建设、严格遵守国家宪法法律、构建较为完整的国防法治体系、提高军队战斗力、依法保障军人合法权益、发挥党内法规在国防法治建设中的重要作用等基本特色。为了全面推进新时代国防法治建设创新发展,必须进一步加快完善国防法治体系、突出重点领域立法、推进军民融合法治建设、清除腐败和保持人民军队本色,为实现党在新时代的强军目标提供法治保障。

The rule of law for national defense is an important part of the socialist rule of law system with Chinese characteristics,covering all major areas of national defense and military construction. Over the past 70 years since the founding of new China,China’s national defense and military development have always followed the rule of law and gone through a glorious course. The initial period laid a solid foundation for the development of national defense and the rule of law.Reform and opening up to promote the all-round development of national defense and the rule of law. The 18 th CPC national congress ushered in a new era of national defense and rule of law. At present,such basic features as the party’s leadership in the rule of law for national defense,strict adherence to the country’s constitution and laws,the establishment of a complete national defense rule of law system,the enhancement of the combat effectiveness of the armed forces,the protection of the legitimate rights and interests of servicemen in accordance with the law,and the important role of inner-party regulations in the construction of national defense rule of law have taken shape. In order to comprehensively promote the innovative development of the rule of law in national defense in the new era,it is necessary to further accelerate the improvement of the national defense rule of law system,highlight legislation in key areas,promote the integration of military and civilian rule of law,eliminate corruption and maintain the nature of the people’s armed forces,so as to provide legal guarantee for the realization of the party’s goal of strengthening the armed forces in the new era.
