Educational Policies and Laws for the Elderly: Retrospection,Introspection and Suggestions

改革开放近四十年,我国老年教育政策法规的发展经历了探索起步期、确立稳步期和转型发展期三个阶段,虽然其数量初见规模,体系初具雏形,但在立法根据、体系和内容上依然存在着一定的缺陷;同时,在法学研究和司法实践中,老年教育政策法规也一直处于被忽视的地位,这势必会阻碍我国老年教育事业可持续发展的进程.因此,完善我国老年教育政策法规的建议有:加强老年教育及其政策法规的理论研究,推进《终身教育法》/《成人教育法》单独立法,发挥老年教育政策促进法律完善及科学立法的功能,健全老年教育政策法规落实的法律监督体系等.

In nearly 40 years of reform and opening up,the development of China’s educational policies and laws for the elderly have gone through three stages,namely,the initial stage of exploration,the steady stage of establishment,the transition and developing stage. Although the number is beginning to show its scale and the system is beginning to take shape,there are still many defects in lawmaking basis,the system and contents. At the same time,in the study of law and judicial practice,the research on the laws and policies of education for the aged has been in a neglected state,which certainly will hinder the sustainable development of education for the old in our country. There are some suggestions for perfecting the educational policies and laws for the elderly: to strengthen the theoretical study on the education and polices and laws for the elderly,to promote the separate legislations of Lifelong Education and Adult Education,to develop the functions of the elderly education policies promoting the legal perfection and scientific legislation,and to perfect the legal supervision system in the implementation of the elderly education policies and laws.
