Judicial Trust:Concept,Theory and Application

作为政治信任的一个维度,司法信任是国家司法机构在观念上的体现。20世纪90年代以来,司法信任的研究开始不断发展,并且产生广泛的影响。本文首先界定司法信任的概念和测量方式,并且对司法信任进行了跨国和跨时间的比较。整体而言,中国公众对司法机构的信任较高,并且长期处于高位。进一步的,本文详细分析了各种司法信任的理论,并且分析其优点和不足,进而讨论各种理论在中国的应用。最后,本文分析如何应用司法信任的理论来提升中国公众的司法信任。

As a dimension of political trust,judicial trust is a conceptual manifestation of the state judicial institution.The research on judicial trust began to develop in the 1990 s and has exerted an extensive influence.This paper defines the concept and measurement modes of judicial trust,and compares judicial trust across different countries and time.On the whole,in China,the public’s trust on the judiciary stays high for a long time.Furthermore,this paper analyzes various theories of judicial trust in details,and also their advantages and weakness,and then discusses the application of various theories in China.Finally,this paper analyzes how to use the theories of judicial trust to enhance the judicial trust of the Chinese public.
