论物业服务合同中的减价责任

A Study on Price Reduction Liability in Realty Service Contract

减价责任具有平衡合同利益的重要功能,在一方存在履行瑕疵后相对方较难证明实际损失且还不得不以瑕疵履行的事实为基础继续履行的合同中,减价责任无疑是最佳的救济方式。物业服务合同中的服务企业存在履行瑕疵时个体的业主无法解除合同且较难证明实际损失的特点,高度契合了减价责任的适用条件。司法实践中过分考虑物业服务合同群体性特点而对减价责任所持的保守态度违反公平原则,也不利于物业服务行业发展。减价责任的适用上应结合物业服务的职责范围及实际服务的瑕疵程度进行综合判定,对达到严重瑕疵及以上程度者应果断地酌情减价。

Price reduction liability has an important function to balance the parties' interests,which is the best way of relief for the other party who can't cancel the contract and prove actual loss when one party defectively performs the contract. The characteristics that individual owner can t rescind the contract and prove the actual loss when the service enterprise defectively performs the realty service contract highly match the application of price reduction liability. If we excessively consider realty service contract's group characteristics and hold a conservative attitude in judicial practice,it will violate the principle of fairness and also is not conducive to the development of realty service industry. We need to strictly apply the price reduction in accordance to the realty service company's responsibility and the drawbacks of the actual service levels. If the realty service has serious flaws or socioeconomic status,we should be determined to reduce the price.
