A Legislative Study on the Civil Service by Publication in China

公告送达在送达体系中发挥着举足轻重的作用。从立法上看,公告送达呈现出限缩适用的趋势,且规范性越来越高。目前,立法缺位导致的司法实践中公告送达适用标准不一等问题时有发生,公告期限过长及其引发的当事人恶意拖延诉讼等,也影响了诉讼效率。因此,应完善公告送达的立法,重新确定其适用的前提条件,缩短公告期限,同时公告方式需多元化、层次化、立体化,以发挥公告送达应有的强制通知及诉讼信息传播功能。

Service by publication plays an important role in the service system.From the perspective of legislation,service by publication tends to be restricted and applicable,becoming more and more standard.Currently,the lack of legislation leads to the non-uniform applicable standard of service by publication in judicial practice.Moreover,the announcement period is too long,causing the parties to delay the litigation maliciously.All of these affect the efficiency of lawsuit.So,we should perfect the legislation,re-determine the premise condition of service by publication and shorten the announcement deadline.At the same time,service by publication should be diversified,multi-leveled,and three-dimensional so as to play its due roles of mandatory notification and spreading litigation information.
