基于玉屏风散相关专利分析的经典名方中药复方制剂知识产权保护策略思考

Strategic Thinking on Intellectual Property Rights Protection of Classical Representative Famous Prescriptions Based on Patent Analysis of Yupingfeng Powder

经典名方是古代中医典籍记载的应用广泛、疗效确切的传统方剂。本文对经典名方玉屏风散相关专利进行检索整理,对玉屏风散相关专利的申请趋势、法律状态、申请人及委托代理情况、专利内容进行了分析,以此为例总结了目前经典名方专利保护现状和存在的问题,并在此基础上结合现阶段政策法规提出专利、商业秘密和标准相结合的经典名方中药复方制剂知识产权保护策略,为经典名方中药复方制剂知识产权保护提供参考。

Classical representative famous prescriptions (CRFP )is a kind of traditional prescription,which is widely applied,has obvious curative effect and recorded in TCM Classics.In this paper,the patent applications of Yupingfeng Powder were sorted and refined in order to analyze the application trend,legal status, applicants and agents,and the contents.Take Yupingfeng Powder for example,the paper analyzed the present situation and problems of CRFP patents protection.On this basis,combined with current policies and regulations,the intellectual property right protection strategy of the CRFP combining patent,trade secret and standard is proposed,which provides a reference for the intellectual property right protection of the CRFP.
