外国人永久居留制度的法律属性研究

On the Legal Attribute of Foreigner’s Permanent Residence System

外国人永久居留制度是移民法领域的一项重要制度,科学界定其法律属性是我国永久居留制度立法的前提和基础。当前,我国永久居留制度的法律属性尚不明朗,无法对立法实践起到很好的指导作用。通过对外国人永久居留制度的形式属性和实质属性进行分析,得出外国人永久居留制度是具有国家主权特性的行政许可制度的结论,为我国永久居留制度的立法完善提供理论基础和发展方向。

Foreigner’s permanent residence system is an important system in immigration law. Scientific definition of its legal attribute is the premise and basis for the legislation of permanent residence system in China. At present, the legal attribute of our permanent residence system is still unclear. As a result, it can’t put the legislation practice under the guidance of theory better. By analyzing the formal and substantive attribute of foreigner’s permanent residence system, we can draw a conclusion that foreigner’s permanent residence system is an administrative licensing system with national sovereignty characteristics. Then it may provide a theoretical basis and development direction for the legislative perfection of permanent residence system in China.
