道路交通安全管理中道路范围的界定研究

正确界定道路范围,对于履行管理职责、判定罪与非罪、区分此罪与彼罪、明确管辖分工及解决法律适用等问题具有重要作用。我国《道路交通安全法》对道路含义的解释突出了道路的公共通行属性,但判定某通行区域是否属于道路交通安全管理中的道路范围,不能仅仅以其是否具备公共通行属性作为唯一标准。具备公共通行属性、具有管辖主体和具备通行汽车技术条件是准确界定道路范围的不可或缺的必备条件。

Correctly defining the range of a road plays an important role in fulfilling management responsibilities, judging crime or non-crimc, distinguishing between one crime and another, clarifying jurisdiction range and solving the law application issues. The explanation to the ^road'* in The Law of the People's Republic of China on Road Traffic Safety highlights the public passage attribute of the road. However, when judging whether or not a passage area is within the range of a road in road traffic management, the public passage attribute of it can not be taken as the only criteria. Having public passage attribute, having a subject of jurisdiction and meeting technical conditions for vehicle safe passage are three indispensable factors for correctly defining the range of a road.
