我国公共图书馆法人治理机制研究

《公共图书馆法》明确规定国家推动公共图书馆法人治理结构的建立健全。公共图书馆法人治理的独特性决定了需要适用不同于公司治理的策略。近年来我国在推行公共图书馆法人治理过程中,虽然逐步走向制度化与组织化,但仍存在理事会决策的独立性和专业性受质疑、社会参与程度低和图书馆章程缺乏特性等障碍,使得法人治理的功能和作用无法有效发挥。公共图书馆在面对公众日益增长的文化需求时,应依据法律法规和图书馆章程,加强科学决策体系和信义义务的构建,提高社会参与度,逐步完善法人治理机制。

The Public Library Law clearly stipulates that the state promotes the establishment and improvement of the corporate governance structure of public libraries. The uniqueness of corporate governance of public libraries determines the need to apply strategies different from corporate governance of companies. In recent years, in the process of implementing the corporate governance of public libraries in China, although it has gradually become institutionalized and organized, there are still obstacles such as the independence and professionalism of the decision-making of the board of directors being questioned, the low degree of social participation and the lack of characteristics of library charters, which make the functions of corporate governance unable to play effectively. In the face of the growing cultural needs of the public, public libraries should strengthen the construction of scientific decision-making system and credit obligations, improve social participation and gradually improve the corporate governance mechanism in accordance with laws, regulations and library charters.
