嵌入性行为、互补性制度与整体性治理:集体劳动争议治理系统性构建的理论基础 被引量:1

Embedded Action, Reciprocal Institutions and Holistic Governance:The Systematic Construction of Governance Upon Collective Labour Disputes

摘要 在我国,集体劳动争议治理逐渐成为近年来各地方政府重视的劳动关系工作,一些地方政府整试图构建系统性的集体劳动争议治理机制。但是,对于系统性的发展的方向尚缺乏相关的理论研究,特别是对于集体劳动争议治理系统性发展的方向。如何重新以具体的概念来解释系统性构建路径则是本文关照的问题。本文首先对集体劳动争议这一概念的多向度性进行解读,继而基于多学科相关理论的基础上,提出了以嵌入性行为、互补性制度和整体性治理来阐述系统性构建集体劳动争议治理的内涵。因循这一内涵,本文结合当前地方政府治理集体劳动争议的经验,提出了治理的基本思路与可行性策略。 In recent years,the governance upon collective labour disputes has become the core task of the regional government.Governments in a few areas embarked on experimentation of mechanism of collective dispute resolution system.However,the theoretical study on this tendency still remain vacant,in particular the development of collective labour disputes governance system.Therefore,the focus lies on how to articulate the systematic construction via explainable concepts.The article starts elaborating on the concept of collective labour disputes from multiple dimensions.And based on theoretical resources from different approaches,three analytical concepts have been proposed,including embedded action,reciprocal institution as well as holistic governance.Accordingly,the essence of collective labour disputes in systematic governance is also explored.The theoretical research serves to lay solid foundation for the change for systematic construction of collective labour disputes.
