摘要
研究目的:探索中国自然资源法律体系存在问题及优化路径,为落实自然资源统一管理要求提供建议。研究方法:文本分析法。研究结果:中国自然资源法律体系较为完整,但与新时代要求相比,在效力层次优化、概念联系强化、权责设置完善、内容体系完整方面有待提升。研究结论:针对上述问题,提出中国自然资源法律体系的完善路径:(1)采用“主干+专项”模式,设立自然资源基本法;(2)推动自然资源相关法律法规立、改、废工作;(3)强化法律体系的责任约束,丰富完善体系内容。
The purpose of this study is to explore the problems and optimization path of China's legal system of natural resources, and to provide suggestions for implementing the unified management requirements of natural resources. The method employed is text analysis. The results show that China's legal system of natural resources is relatively complete,however, compared with the requirements of the new era, it is necessary to improve the level of legal effects, the clarity of concepts and connections, the equality between legal rights and responsibilities, and the integrity of the content system.In conclusion, China's legal system of natural resources should be improved in the following aspects: 1) adopting a"trunk and special" model to establish the basic law of natural resources;2) promoting legislation, revision and abolition of laws and regulations related to natural resources;3) strengthening constraints, realizing the equality in rights and responsibilities and enriching the content of the legal system.
