摘要
次承租人承租风险的来源有很多方面,除次承租人自身风险意识不强外,主要是转租法律关系相对复杂和合同法中任意性规范应用产生的消极作用。次承租人不应当在没有预见、毫无违约或过错的情况下承担非正常的风险,有必要在法律政策上给予更多的保护。能够防范这些风险的有效途径是向次承租人公开出租人与转租人签订的合同,建议在国家立法中规定转租人如实向次承租人提供原始租赁合同的义务,并规定相关责任承担。
There are many sources of sub-lessee's rental risk. Except the sub-lessee's own weak risk awareness, the main negative effects are the relatively complex legal relationship of sub-lessee and the arbitrary application of norms in contract law. As a weak individual in life or economy, the sub-lessee should not bear the risk of premature termination of the sub-lease contract or excessive rent burden without foresight, breach of contract or fault. It is necessary to offer more protections in legal policies. The effective way to prevent these risks is to disclose the contract signed between lessor and sub-lessee to sub-lessee. It is suggested that sub-lessee should be obliged to provide original lease contract to sub-lessee truthfully in national legislation and the relevant liability in the national legislation.
