海域使用权变更土地使用权的困境研究

Study on the Dilemma of Land Use Right Change in Sea Area Use Right

《海域管理法》仅规定了海域使用证换发土地使用证的登记环节,而海域和土地管理部门权力不衔接、规划不衔接等,导致填海项目的海域使用权转换为土地使用权困难重重。本文简单阐述不同换证模式特点和影响,分析海域使用权变更土地使用权的实际困难及其原因,提出有关建议。

The Sea Area Management Law only stipulates the registration link of issuing land use certificates for sea area use certificates.However,the power of sea area and land management departments is not linked up and planning is not linked up,which makes it difficult to convert the right of sea area use to the right of land use for reclamation projects.This paper briefly expounds the characteristics and impacts of different certificate exchange modes,analyses the practical difficulties and reasons of land use right change of sea area use right,and puts forward relevant suggestions.
