摘要
近期在运行中的旅客列车上发生了多起强占他人座位的“霸座”事件,引起了社会各界的广泛关注。在霸座行为发生时,旅客列车上的管理人员却没有相应的合法手段当场阻止这类公然侵害法益的行为。现行法律对此类现场惩戒的主体和方式的缺失,使得火车霸座事件中受害人的合法权益得不到及时保护,遭到破坏的公共秩序得不到即时维护。文章通过分析航空业有关规定,提出对运行中的火车霸座行为设置现场惩戒主体和惩戒方式的建议。
Recently, there have been a number of incidents on the running passenger trains in which passengers forcibly occupy other people's seats, which have aroused wide concern from all walks of life. At the time of bullying, the managers on the passenger trains did not have the corresponding legal means to stop such flagrant infringement of legal interests on the spot. The lack of subjects and methods of such on-site punishment in the current law makes the legitimate rights and interests of victims in the train bully incident not be protected in a timely manner and the damaged public order not bemaintained in a timely manner. Based on the analysis of the relevant provisions of the aviation industry, the author puts forward the suggestions of setting up on-site disciplinary subjects and disciplinary measures for the train bully behavior in operation.
