On Properties of "Deep Link" Behavior in the Copyright Law

“深度链接”行为的著作权法属性界定问题一直是理论与司法实务中长期存在争论的焦点,其根本原因在于有关信息网络传播权的侵权界定标准尚未形成统一的定论。争论之下更应回归《世界知识产权组织版权公约》及我国《著作权法》的相关规定明确统一的信息网络传播权侵权界定标准。在信息网络传播权的视角之下,借助直接侵权的规制路径,解决“深度链接”侵权纠纷问题,进一步保护著作权人的网络版权。

The definition of "deep link" behavior in the copyright law has been the focus of debate in both the theory and judicial practices for a long time with a fundamental reason that there has not been a unified conclusion on the definition of infringement of information network communication right. The controversy should return to the relevant provisions of World Intellectual Property Organization Copyright Treaty and the Copyright Law of our country. Under the perspective of information network communication right, the thesis resolves the problem of "deep link" infringement dispute by means of direct infringement regulation path in order to protect copyright owner's network copyright.
