摘要
文章分析当前在实现农民住房抵押权中出现的“房地分离”、受让对象范围限定过窄、农村信用体系落后等问题,借鉴各试点地区以农房确权颁证为前提,以完善市场产权交易为补充,以制度建设为最后保障,通过扩大受让对象范围、引入推定租赁制度、多措并举维护农村产权交易安全,化解金融机构的信贷风险,为农民住房抵押权的实现寻找出路。
By analyzing the problems in the way of realizing current farmer housing mortgage right,such as“the separation of house and land”,limited scope of the recipient object,and a backward rural credit system,it proposes to learn from the pilot cases where the rural housing is confirmed and verified with an improved trading right as supplement.The system construction is the guarantee.The scope of recipient object should be enlarged.The leasing system should be introduced.Multiple measurements should be applied together to safeguard the rural housing right trade and decrease the credit risk of financial institutions.These are the solutions to the realization of farmer housing mortgage.
